Purpose and scope of the document

"The Policy of LLC "ECKSE" (hereinafter also referred to as the Company) regarding the processing of personal data" (hereinafter - the Policy) defines the position and intentions of the Company in the field of processing and protection of personal data, in order to observe and protect the rights and freedoms of everyone and, especially, the right to privacy, personal and family secrets, protection of their honor and good name.

Policy is strictly executed by heads and employees of all structural divisions and branches of LLC "ECKSE".

Policy action covers all personal data of subjects processed in the Company with application of automation means and without application of such means.

Any subject of personal data has access to the present Policy.

Definitions

Personal data - any information relating to directly or indirectly identified or defined by an individual (citizen). That is, such information may include, inter alia: Full name, year, month, date and place of birth, address, information about family, social, property status, information about education, profession, income, information about the state of health, as well as other information.

Processing of personal data - any action (operation) or a set of actions (operations) with personal data performed with or without the use of automation tools. Such actions (operations) may include: collection, receipt, recording, systematization, accumulation, storage, clarification (updating, modification), extraction, use, transfer (distribution, provision, access), depersonalization, blocking, deletion, destruction of personal data.

Subjects of personal data LLC «ECKSE» processes personal data of the following persons:

LLC "ECKSE" employees;
Subjects, with whom contracts of civil-law character are concluded;
Candidates for filling of vacancies in LLC "ECKSE";
Clients of LLC "ECKSE";
LLC ECKSE's registered site users;
representatives of legal persons;
Suppliers (individual entrepreneurs).

Principles and conditions of personal data processing

ECKSE LLC understands security of personal data as security of personal data against illegal or casual access to it, destruction, change, blocking, copying, granting, distribution of personal data, and also against other illegal actions in relation to personal data and takes necessary legal, organizational and technical measures for protection of personal data.

Processing and security of personal data in LLC "ECKSE" is carried out according to requirements of the Constitution of the Russian Federation, the Federal law No. 152-FZ "About personal data", subordinate acts, other defining cases and features of processing of personal data of federal laws of the Russian Federation, governing and methodical documents of FSTEC of Russia and FSS of Russia.

When processing personal data LLC "ECKSE" adheres to the following principles:

Legality and fair basis;
Restriction of personal data processing to achievement of specific, predetermined and legitimate purposes;
Inadmissibility of personal data processing, incompatible with the purposes of personal data collection;
not to combine databases containing personal data, the processing of which is carried out for purposes incompatible with each other;
processing of personal data, which are consistent with the purposes of their processing;
compliance with the content.

The Company shall process personal data only in the presence of at least one of the following conditions:

the processing of personal data is carried out with the consent of the subject of personal data to the processing of his personal data;
Processing of personal data is necessary to achieve the objectives provided by law, to implement and perform the functions, powers and duties imposed on the operator by the legislation of the Russian Federation;
Processing of personal data is necessary to perform the contract, which party or beneficiary or guarantor under which the subject of personal data, as well as for the conclusion of the contract on the initiative of the personal data subject or the contract under which the subject of personal data will be a beneficiary or guarantor;
Processing of personal data is necessary for exercise of the rights and legitimate interests of the Company or third parties or to achieve socially important objectives, provided that the rights and freedoms of the subject of personal data are not violated;
Processing of personal data, access to which is granted to an unlimited number of persons by the subject of personal data or at his/her request;
Processing of personal data subject to publication or compulsory disclosure according to the federal law is carried out.

ECKSE LLC has the right to entrust processing of personal data of citizens to the third parties, on the basis of the contract concluded with these persons.

Persons carrying out processing of personal data on behalf of ECKSE LLC undertake to observe principles and rules of processing and protection of the personal data stipulated by the Federal law No. 152-FZ "About personal data". For each person the list of actions (operations) with the personal data which will be made by the legal person carrying out processing of the personal data, the purposes of processing, duty of such person to observe confidentiality and provide safety of the personal data at their processing is defined, and also requirements to protection of the processed personal data are specified.

In cases established by the legislation of the Russian Federation, LLC "ECKSE" has the right to carry out transfer of personal data of citizens.

For the purpose of information support in the Company can create publicly accessible sources of personal data of employees, including directories and address books. Publicly available sources of personal data with the consent of an employee may include his/her surname, first name, patronymic, date and place of birth, position, contact telephone numbers, e-mail address. Information about an employee shall be excluded from publicly available sources of personal data at any time at the employee's request or by order of a court or other authorized governmental agencies.

The Company shall destroy or depersonalize personal data upon attainment of the processing objectives or if it is no longer necessary to attain the processing objectives.

Rights of the subject of personal data

The citizen whose personal data is processed by ECKSE LLC has the right:

To receive from "ECKSE" LLC

confirmation of the fact of processing of personal data by LLC "ECKSE";
Legal basis and purposes of personal data processing;
Information on methods of personal data processing applied by ECKSE LLC;
Name and location of ECKSE LLC;
Information about persons, who have access to personal data or to whom personal data may be disclosed on the basis of the contract with ECKSE LLC or on the basis of the federal law;
The list of processed personal data concerning the citizen from whom the inquiry was received and a source of their reception if other procedure of granting of such data is not provided by the federal law;
Information about the timing of the processing of personal data, including the period of their storage;
Information about procedure of execution of rights, stipulated by the Federal Law "On personal data" № 152-FZ;
Information about ongoing or proposed trans-border transfer of personal data;
Name and address of the person processing personal data on behalf of ECKSE LLC;
Other information, provided by the Federal law "About personal data" № 152-FZ or other federal laws;
To demand specification of the personal data, their blocking or destruction in case the personal data are incomplete, outdated, inaccurate, illegally received or are not necessary for the declared purpose of processing;
To withdraw its consent to the processing of personal data;
To demand elimination of unlawful actions of LLC "ECKSE" concerning his personal data;
To complain of action or inaction of LLC "ECKSE" to the Federal Service for Supervision in the Sphere of Telecom, Information Technologies and Mass Communications (Roskomnadzor) or in court if the citizen considers that LLC "ECKSE" carries out processing of his/her personal data with violation of requirements of the Federal Law № 152-FZ "About Personal Data" or otherwise violates his/her rights and freedoms;
To defend his rights and legitimate interests, including damages and/or compensation of moral damage in court.

Liability

In case of default of performance of provisions of the present Policy, LLC "ECKSE" bears responsibility according to the current legislation of the Russian Federation.

If you send an official request to ECKSE Ltd, you must specify in the text of the request:

FULL NAME;
Number of the main document certifying identity of the subject of personal data or his/her representative, information on date of issue of the specified document and the body that issued it;
Information confirming your participation in relations with ECKSE LLC or information otherwise confirming the fact of processing of personal data by ECKSE LLC;
Signature of the citizen (or his legal representative). If the request is sent electronically, it must be in the form of an electronic document and signed by electronic signature in accordance with Russian law.

Information about realized requirements to protection of personal data

At processing personal given LLC «ECKSE» takes necessary legal, organizational and technical measures for protection of the personal data from illegal or casual access to them, destruction, change, blocking, copying, granting, distribution of the personal data, and also from other illegal actions in relation to the personal data.

These measures, in accordance with Federal Law No. 152-FZ "On Personal Data", include:

determination of threats to security of personal data during their processing in personal data information systems;
Application of organizational and technical measures to ensure security of personal data during its processing in personal data information systems, necessary to meet the requirements to protection of personal data, implementation of which ensures the levels of protection of personal data established by the Government of the Russian Federation
Application of duly approved conformity assessment procedure for information protection tools;
Assessment of effectiveness of measures taken to ensure security of personal data prior to commissioning of the information system of personal data;
Detection of unauthorized access to personal data and taking measures;
Restoration of personal data modified or destroyed as a result of unauthorized access to such data;
Establishment of rules of access to personal data processed in personal data information system, as well as ensuring registration and accounting of all actions performed with personal data in personal data information system;
Control over measures taken for ensuring security of personal data and level of protection of personal data information systems;
Accounting of computer media of personal data;
Arrangement of access control to the Company's premises;
Placement of technical means of personal data processing within the protected area;
Maintaining technical means of security, alarm system in constant readiness;
Monitoring the actions of users, conducting investigations on the facts of personal data security breaches.

In order to coordinate personal data security activities, LLC "ECKSE" appointed persons responsible for personal data security.
